Women’s group threatens legal action over single-sex spaces

Women’s rights activists have given the Scottish government a deadline to comply with the decision of the United Kingdom Supreme Court on biological sex.

The Sex Matters group has issued a warning letter of legal actions in 14 days if the ministers continue to delay new policies and guidance.

The executive director Maya Forster said that toilets of a single sex and changing facilities must be provided, with all the scottish public bodies necessary to take “immediate measures.”

The Scottish government says that it accepts the judgment of the Supreme Court and is waiting for a new orientation of the Commission on Equality and Human Rights.

In April, the Supreme Court was put on the side of the campaign group for Scotland in a historical case against the Scottish government.

The Scottish government had argued that trans people with a gender recognition certificate (GRC) were entitled to same sex protections than biological women.

After the ruling, the Prime Minister of Scotland, John Swinney, said that a new orientation of sexual rights was being developed.

The Human Rights Commission (EHRC) is currently consulting a reviewed practice code.

Since then, he has published a provisional guide, which includes saying that trans women should not be allowed to use facilities for women in places such as hospitals, stores and restaurants.

However, Sex Matters is urging the Scottish government to implement the ruling of the Supreme Court “in its entirety and without delay.”

The ruling of the Supreme Court in April brought strong criticism from the transgender community

Sex Matters states: “While it is correct that the EHRC is consulting in a practical way in the updates of its practice code, that is not an invitation, particularly to public authorities, to act illegally in the Meanime.”

He has asked the Scottish government to confirm within 14 days that he accepts that changing bathrooms and facilities must be provided in a biological sexual basis, with any mixed sex installation in addition to this.

Sex Matters also says that any published government orientation that refers to trans people who access single -sex spaces must be immediately suspended.

He also asks the Scottish government to issue a statement that requires that all public bodies and service providers take immediate measures in the single -sex facilities.

He said it was not acceptable for illegal continuous practices while waiting for an updated legal guide from the EHRC.

Transgender criticism

The Scottish government said it would respond to the letter “in due time.”

A spokesman said: “The Scottish government has been clear that we accept the sentence of the Supreme Court.

“We are reviewing policies, guidance and legislation affected by the sentence.

“This will prepare us to take all the necessary measures when the EHRC publishes its code of legal practice revised and associated orientation for services, public functions and associations.”

The ruling of the Supreme Court brought strong criticism from the transgender community and supporters that they were being excluded from public life.

Former Prime Minister Nicola Sturgeon said he could make the life of trans people “almost unnecessis.”
